Terms & Conditions for Training Courses
These terms and conditions are between Laura & Paul Macadam-Slater T/A Emergency Action Training (also known as Emergency Action Training or the supplier) and the customer (also known as the customer, student or Learner)
Onsite Courses (at customer’s premises or location other than the trainer’s premises)
Offsite Courses (premises normally supplied by the supplier)
Distance Learning Courses (delivered via Microsoft Teams video communications to your home or workplace)
The customer will confirm course places using an enrolment form per student which is supplied by Emergency Action Training. The sending out of enrollment forms establishes a legally binding contract between the supplier and the customer whether it be by post, email, an online form or in person.
Bookings are placed on the understanding that the following terms and conditions are agreed by the customer.
Onsite Courses
All training courses offered by Emergency Action Training will be provided by suitably registered and accredited trainers. The trainer will arrive at your premises on the date agreed and at least half an hour before the agreed course start time to permit setting up of equipment. They will also require time after the course has concluded to pack equipment away.
Should you need to cancel your booking or part of your booking, this includes any ‘no-shows’ & late arrivals for the course, you will be subject to the following cancellation fees:
- – Less than 7 days’ notice: 50% of the course fee
- – Less than 3 days’ notice: 100% of the course fee
- – The full cost of any overnight accommodation
- – The full cost of any agreed travel fees
Cancellations must be received in writing by the due date and must be confirmed as being received by Emergency Action Training. The preferred method of cancellation is by email.
The date/time stamp of the email will be taken as the time notification for the calculation of any cancellation fees. The use of a read receipt on a cancellation email will not be acknowledged as confirmation of cancellation. Telephone cancellations will not be accepted under any circumstances.
On occasions where the booking has to be cancelled by Emergency Action Training due to any unforeseen circumstances, it is accepted by the customer that Emergency Action Training cannot compensate the customer for any losses arising from the cancellation. In these circumstances, the customer will be offered a rescheduled date or a full refund if the course invoice has been prepaid.
If you have booked an onsite course and the site conditions are not appropriate for the provision of training, the customer agrees to abide by the trainer’s decision as to whether the site is fit for purpose and agrees that the full course fee is still payable if training were not to proceed on the basis of unsuitable training conditions.
The training venue must meet acceptable health and safety standards and be conducive to learning with sufficient:
- – Size
- – Floor surfaces
- – Seating
- – Writing surfaces
- – Toilet facilities
- – Heating
- – Ventilation
- – Cleanliness
- – Access to drinking water
- – Assistance with carrying training equipment upstairs if there is no lift
If you are unsure, Emergency Action Training will be happy to advise you on the suitability of your premises.
Offsite Courses
Emergency Action Training will offer a range of offsite courses provided by suitably registered and accredited trainers.
Should you need to cancel your booking for an offsite course,this includes any ‘no-shows’ & late arrivals for the course, you will be subject to the following cancellation fees:
- – Less than 7 days’ notice: 50% of the course fee
- – Less than 3 days’ notice: 100% of the course fee
- – Full cost of any overnight accommodation
- – Full cost of any agreed travel fees
- – 100% of the venue booking fees
Distance Learning Courses
Any course delivered via distance learning will be conducted via the Microsoft Teams video communication platform. You will be required to follow a link sent to you on to your Laptop or Desktop computer before the course start date and ensure that you have tested your sound, microphone & video. Make sure that you have a comfortable chair to sit on and as you may be asked to stand up & sit down at various points during the course, please ensure that you are fully dressed. Your Laptop or Desktop computer must be in a suitable room i.e. not a bedroom
Payment
A legally binding contract will be formed when Emergency Action Training sends out enrolment forms with the agreed date stated upon.
You agree to be invoiced by email from Emergency Action Training once final numbers have been confirmed. The invoice is payable upon return unless prior agreement for credit has been made in writing to Emergency Action Training. Details for payment by BACS is stated on our invoices, payment by cheque must be made payable to Laura Macadam-Slater. Payment in cash is also accepted.
If you fail to adhere to these conditions, Emergency Action Training reserve the right to cancel the customer’s course with the full course fees still becoming payable.
Certificates will be held until such time as the course fees are paid in full.
Late payment of invoices are subject to 5% compound interest of the invoice total per 7 day period or part of. The customer accepts that late payment charges can be made after the original invoice has been paid in full if paid late.
General Terms & Conditions for Courses
It is the customer’s responsibility to ensure that students are free from any condition that would affect their capability to carry out any necessary physical/practical assessments. The student must be capable of successfully performing all physical/practical assessments required to complete the course.
Emergency Action Training should be notified in advance of any course if any student needs assistance in relation to written assessments, this includes notification if the student does not have English as their first language. The customer is free to provide a translator at the customer’s expense, however all assessments, both written & practicable will & must be carried out in English without the use of a translator.
Emergency Action Training cannot guarantee that every student will achieve the learning outcomes to pass any course. No refund will be given should a student fail a course.
To be eligible to attend a First Aid at Work Re-qualification course, students must present a valid First Aid at Work certificate. This must be issued by a recognised regulated training provider. It needs to be in date on the last day of the re-qualification course. Presentation of the in date certificate must be made prior to the re-qualification course start date.
All students must wear suitable clothing for the course. It is accepted that they may be doing some floor based practical activities or other practical activities.
The trainer reserves the right to remove any student who is felt to be unsuitably dressed for the course. Lipstick must not be worn during First Aid courses and any learner wearing lipstick will be required to remove it.
If a student arrives late for a course, or is absent from any session, Emergency Action Training reserve the right to refuse to accept the student on the course. In these cases the full fee remains payable.
All students must provide photo ID to the trainer on the first morning of the course. Without this they will not be permitted to undertake any part of the course. In these cases the full fee remains payable.
If it will prove difficult to provide photo ID, please contact Emergency Action Training to discuss other options.
It is the customer’s responsibility to provide lunch for their students, or to ensure that they have been informed to bring their own.
The trainer reserves the right to remove any disruptive student from the course where this is affecting the other students.
Maximum number of students per course is stated on the relevant course page on Emergency Action Training’s website. Where more students are booked than permitted on a course, the booking will be treated as separate bookings over the number of days required.
External Quality Assurance Visits
From time to time Emergency Action Training will have an External Quality Assurance visit. This will be by a person appointed by Qualsafe Awards. This is to ensure the quality and content of the course being delivered. It is not always known when an EQA visit will take place. Therefore the customer accepts that entry to a building and/or course by an EQA must be permitted
